On the Principle of Legality in Procedure Establishment

程序是指事物运动的某种次序或过程或环节,社会程序是人们按照一定的社会运动规律经过无数次的实践,摸索、总结形成的主观行动守则。这些行动守则虽然是人们主观意志的产物,但它必须符合人类社会发展的规律性。程序设置的一个重要原则就是法制原则,即一切程序的设置都要符合和遵守国家的根本大法和有关法律,这些程序包括立法程序、执法程序和守法程序等。

Procedure is an order or a process of conducting the business. Social procedure is the code of conduct formed in the course of countless practice and explorations in accordance with certain laws of social development. Although the code of conduct is a product of human＇s subjective will, it should accord with the law of social development. One of the important principles of establishing procedures is the principle of legality which demands that all procedures, including legislative procedure, enforcement procedure and law-abiding procedure, be established in line with the fundamental law and relevant laws.
