广告语是借助文学艺术手段,追求高度的创意,对商品和服务信息的一种文字表达方式。广告语是智力创造成果,具有独创性、可复制性的特点,符合著作权法所保护的“作品”的一般特征。侵犯广告语著作权,要承担相应的民事责任、行政责任或刑事责任。
Advertising language, which pursues high level of creativity, is one type of written expression popularizing commodity and service information by way of literary and artistic means. Advertising language is achieved by intelligent creation and is characterized by originality and duplication, which conform to the general characteristics of works protected by copyright law. Anyone or company infringing the copyright of advertising language will undertake the corresponding civil, administrative and criminal responsibilities.
