对专利法修订草案的几点建议

Recommendations on the Draft Amendment to the Patent Law

按照《专利法》第三次修改的指导思想，在改法过程中，应当“充分总结我国专利制度实施二十年来的经验和体会”，“重新审视我国《专利法》的各项规定，使之更好地适应我国国情需要”，为“行使专利权提供更为便捷的途径，更为有效地保护专利权”。笔者根据这一指导思想，从保护专利权的角度提出几点修改法律的建议，希望能引起同行尤其是立法者的关注。

Under the guiding principles of the third amendment to the Patent Law, we, in the process of revising the Law, should ＂fully summerise the experience we have accumulated in the enforcement of the patent system in China, look closely again into the provisions thereof, and better adapt the Patent Law to the needs of the present practical situations in China in order to find a more convenient and expedite approach to the enforcement of the patent right, and to more effectively protect the patent right＂.
