A Contrastive Analysis of the Chinese and Western Privacy Right

当代中西价值哲学对隐私权的研究集中在如何界定隐私权、隐私权具有目的性的价值还是工具性价值、隐私权是否有限制、与公权力和知情权的界限如何划分这样一些由来已久的问题的讨论方面,另外还出现了对网络、流行病防治、同性恋等新的领域中的隐私权的研究。西方更多地注重其中深层的理论问题,而中国学者则较多地关注对现象的分析。

Contemporary inquiry to value focuses the studies of the right to privacy on the long-standing issues of how to definite the right to privacy, does it have ends or instrumental value, is there any limitation for it, how to clarify it with public authority and the right to know. In addition, there arises study on the right to privacy on net,in the prevention and cure of epidemic diseases, in homo-sexual relations, etc. The research in the West goes thoroughly on the essential problems, while that in China somewhat stays on the analyses on the phenomenon.
