我国医药产业应对国际知识产权保护的对策

摘要 加入WTO,对医药行业最主要的影响有知识产权保护所引发的新产品开发危机,以及关税下调可能导致的进口产品进一步冲击。加入WTO,医药行业既面临着发展的机遇,也面临着严峻的挑战。从长远看,有利于我国医药管理体制与国际接轨,有利于医药新产品的研究与开发及知识产权保护,有利于获得我国医药发展所需的国际资源,有利于我国具有比较优势的化学原料药、中药、常规医疗器械产品进一步扩大国际市场份额。 The most important influences on the medicine industry after joining in the WTO are the new product development crisis induced by the intellectual property right protection and the possible impact on imported products induced by the customs duty decline. After entering the WTO, the medicine industry is facing development opportunities as well as austere challenges. In the long run, the joining in the WTO is advantageous for China' s medicine management system to integrate with the international standard, is advantageous to the research and development of new medicine products and the intellectual property right protection, is advantageous for China' s medicine industry to obtain more international resources so as to push the medicine development in China, is advantageous to further enlarge the share of Chinese medicine products in the international market, and is advantageous for Chinese medicine enterprises to transform the management mechanism and innovate the system. In brief, joining in the WTO is advantageous to enhance the overall quality and international competitive power of Chinese medicine industry. The major impacts on the medicine industry after China' s entering the WTO are represented in three aspects: the reduction of customs duty, the IPR protection of drugs and the wholesale and retail service of drugs. Facing the impacts on the medicine industry after China's entering the WTO, China takes some measures to protect the IPR in medicine industry so as to improve the comprehensive competitive power of China's medicine industry in the intemational market.
