摘要
近年来，随着人民群众法律意识的提高，消防部队在灭火诉讼中遭遇诉讼案件的数量也呈上升趋势，如果消防部门在灭火救援活动中对法律职责认识不清、不到位，或在履行职责过程中不作为、乱作为，或者履行了职责但缺乏证据意识，资料收集和保存不齐全、不完善，就极易引起行政诉讼败诉案件的发生。
In recent years, fire services have been incrementally caught in the lawsuits stemmed from their action in fire. The lawsuit would be easily lost if the fire sector is not fully aware of their legal responsibility or shows omissions or disorder acts in the fulfillment of their responsibility or collects and holds relevant data in an incomplete way. Therefore, the fire services should take a lesson from the losing of lawsuits in recent years and always be prepared for answering lawsuits.
