债的相对性是债法的重要理论基础。随着市场经济中交易的发展,债的相对性在某些方面有了一些突破,主要表现为债的保全、涉他契约、债权物权化等方面。债的相对性的突破,其目的是为了更好地实现社会公正、达成利益平衡,而不是否定或推翻债的相对性。

The relativity of debt is the important theoretic foundation of debt law. With the development of the business of market economy, the relativity of debt has some breakthrough in certain respect, which is mainly showed as：the maintenance of debt;concerning other contract;obligatory right gets into material right. The aim of the relative breakthrough of debt is to still better realize social justice, achieve benefit balance, but not to negate or overthrow the relativity of debt.
