对中国社会保障立法的展望——建立农村社会医疗保障制度的构想

Prospect of Legislation of Chinese Social Security——An Idea of Establishment of Rural Social Medical Security System.

立法先行是现代社会保障制度作为国家制度安排特征的具体体现,只有通过法律的形式,社会保障才能制度化,普及所有公民。然而中国并没有统一的社会保障法律制度,农村社会保障法律制度的缺失,使农民被排斥于社会保障所构建的安全网之外。展望中国社会保障制度的构建过程,认为农村社会保障体系的建设将是工作的重点。文章试从农村社会医疗保障的视角,略论农村社会保障制度的构建问题。

Legislation going first is a specific embodiment for modem social security system as arrangement characteristics of national system. Only through a form of law, could social security be systematic and popularize all citizens. However, China has not unified social security law system. The absence of rural social security law system makes farmers be outside of safety net that is established by social security. Through looking ahead the process of establishing Chinese social security system, the author thought that building of rural social security system was a key. From the point of view of social security system, the paper discussed the building of rural social security system.
