论行政诉讼与刑事诉讼关联问题之解决

行政诉讼与刑事诉讼关联问题的产生是多种因素作用的结果,其解决应视不同情形而有所区别.对于行政诉讼与刑事诉讼交织但不冲突的关联情形,应当独立进行.对于行政诉讼与刑事诉讼交织并冲突的关联情形,应当遵循"谁为前提谁优先"的原则,裁定正在进行的诉讼,待另一诉讼作出判决之后再恢复原来的诉讼,并根据其诉讼结果作出判决.对于行政诉讼与刑事自诉冲突的处理,应当在兼顾当事人诉权和诉讼经济的基础上解决.

The creation o f related problem on administrative litigation and criminal proceedings is the result of various factors ef- fect,it should be solved according to different situations.The related situation on administrative litigation and criminal proceedings which interweaves but not conflicts should act separately.It should act according to the principle of'the premise,the priority',and restore it while the other legal action's judgment has been made,and make the judgment according to the original legal action.The solution on it should be solved on the basis of giving consideration to both the telling fight of interested party and legal action economy.
