摘要
目前国内体育劳资纠纷救济途径有内部裁决、劳动仲裁和司法诉讼,其中立性、专业性、滞后性等造成了当下体育劳资纠纷不能得到及时有效解决。通过对运用运动员协会来促进其行业协会内部调解的必要性和可行性的分析,强调在各个全国性单项体育行业协会中设立运动员协会来促进和完善体育劳资纠纷的解决。
At present, the ways for sports labor dispute relief in China include internal settlement, labor arbitration and judicial action, and the neutral nature, professional nature and lagging nature therein have resulted in that sports labor disputes nowadays cannot be settled in a timely and effective fashion. By analyzing the necessity and feasibility of using athlete associations to boost the internal intermediation between various industrial associations, the author emphasized that an athlete association should be established in various nationwide single event sports industrial associations to boost and perfect the settlement of sports labor disputes.
