商业秘密权是商业秘密的权利人依法享有的对其商业秘密的支配权利。商业秘密权的财产权属性、权利客体的无形性、权利的法定性及国际条约、各国的立法实践表明商业秘密权是一种知识产权,与其他类型的知识产权相比具有权利主体、权利对象、权利期限和权利保护上的特殊性,其内容包括身份权、保密权、使用权和收益权。
