"Social Dumping" Theory and Anti-dumping

"社会倾销"(Social dumping)是一些发达国家对发展中国家低劳工标准的产品所提出的一种变相的贸易保护理论,并屡次主张在WTO协议中缔结"社会条款"以阻止这种社会问题的倾销。社会倾销理论的产生源于经济发展不平衡导致的劳工标准的差异、发达国家的社会问题和劳资矛盾以及新贸易保护主义抬头。社会倾销理论的实质并不是针对工资、工时等具体的劳动条件的规范,它提倡的主要是人权与民主,它实际上是一套政治标准、人权标准。针对社会倾销壁垒,发展中国家应当通过建立预警机制、完善劳动立法、积极采用相关社会责任标准等措施,以降低其负面效应。

＂Social dumping＂ is a kind of disguised trade self-guarding theory raised by some developed countries whose local sales are threatened or reduced with the arrival of products with low labor standards from developing countries. Moreover,those developed countries have been frequently claiming that certain social provisions should be concluded in the WTO agreement to prevent the social dumping. The ＂social dumping＂ theory originates from different labor standards caused by the imbalance of economic development, social problems and contradiction between labor and capital of developed countries, and the appearance of new trade protectionism. The essential of the ＂social dumping＂ theory is not the labor condition criterion such as wages,working time and so on,but human rights and democracy. In fact, it is a set of political standards and human rights standards.In accordance with the ＂social dumping＂ barrier, developing countries are suggested to reduce its negative effect via such measures as setting up their forewarning system, perfecting their labor legislation and actively adopting their social responsibility standard.
