Study on the Evidences Chain

在刑事证据链中,证据链节是证据链的基本组成单位,证据联结点是证据链的核心。证据链体通过证据链头的联结发挥证明作用。证明某一案件事实的所有证据链集合在一起,构成证据链集。证据链的联结形态有单点联结、多点联结和面联结以及简单联结与多重联结之分,证据链的不同联结形态,其证明力有所不同。证据联结点的出现概率和情节表述直接影响着证据链的证明力。

The evidence link is basic unit of the evidences chain and the evidence joint is the core. The evidences chain exerts the function of proof through its terminals and all the evidences chain that may prove the facts of a case comprise evidence chain aggregate. The form of the chains joint can be point to point connection, multi-access connection and surface connection, which may be simple or multiple. The joint form influences the function of the evidences chain, and the probability of the joint and circumstances expression affect directly its weight of proof.
