The Applicable Principles of Lex Sitae and its Enlightenment

以"物之所在地法"作为涉外物权法律关系的准据法,是当今各国解决物权法律冲突所采用的基本原则。它产生的历史十分悠久,经过漫长的发展过程,成为物权领域适用最为广泛的冲突原则,其适用的范围和例外在各国渐趋一致。本文着重介绍有关"物之所在地法"原则的产生、发展、物之所在地的确定、适用范围、适用例外以及我国现行法律对其的有关规定,以从中获得启示,更好的完善我国的现行立法。

＂Lex situs＂ as a foreign relations interests of the applicable laws. This is the real right to settle the conflict -of- laws adopted by the basic principles. It produced a very long history, after a long process of development, as real areas of the most widely applicable principles of conflicts, its scope and application of the exception in the States is becoming consistent. This paper introduces the ＂lex situs＂ principle for the selection, development, and even the location of the identification, scope of application, exceptions apply existing Chinese laws and its related regulations to gain enlightenment, better improve our existing legislation.
