Study on the Conflict and Coordination of Free Trade and Environment Protection Under The Green Barrier

文章从绿色壁垒涵义与成因分析入手,结合WTO协定,透析由绿色壁垒所突现的自由贸易和环境保护的冲突及根源,并在法律体系内寻求协调贸易与环境关系的平衡点,希望最终能化壁垒为通途。

This paper begins with the analysis of the meaning and causes of formation of Green Barrier. Then, through analyzing the relevant provisions in WTO agreement, it point outs the conflict between free trade and environment protection and its causes under the Green Barrier, and tries to seek the point of counterbalance to coordinate the relationship between trade and environment in the law system, hoping to turn this barrier into a thoroughfare.
