Discussion on the Dynamical Mechanism of Procurator Organs to Investigate the Crime

公诉机关被称为“法律守护人”,其对于公诉案件有很大的自由裁量权。但公诉机关与案件并无直接的利害关系,因此,如何才能确保其为维护国家和人民的利益而尽职尽责是个十分重要的问题。公诉机关追诉犯罪的动力在于民主的制约、对犯罪所产生的恶的抵制、对法律的信仰以及严格的准入机制。

Public prosecutor is called law tutelary. And it has huge power in public prosecution lawsuits. But procurator organs do not have any benefit with these cases. How can we hope they will try their best for public interest？ The drive of procurator organs ward laws are democracy system, to resist evil of the crime, belief of law and strict demand of entry.
