开发区管理委员会的主体地位研究

On the Subject Status of Management Committee of Development Zone

开发区对我国的经济发展发挥了重要作用,但是开发区的运行还存在很多尚待解决的问题,开发区管理委员会的主体地位不明是核心。剖析开发区管理委员会主体地位的现状,探讨开发区管理委员会在现行法律制度框架内的主体定位,提出从应然层面上应将开发区管理委员会定位为各级政府的派出机关,并探明开发区管理委员会行政主体地位的相关问题即职权职责定位和主体关系定位,对开发区的可持续发展至关重要。

Development zone plays a vital role in the economic development of our country, but there exist many problems to be solved in its running, among which the indefiniteness of subject status of management committee of development zone is the core. By analyzing the current situation of the subject status of management committee of development zone and discussing the subject localization of the management committee of development zone under the present law system, this paper proposes that the management committee of development zone should be localized as a dispatched institution of government, and then demonstrates the related problems such as the function and power localization of the management committee of development zone and the relationship localization between the management committee of development zone and other subjects are very important to the sustainable development of development zone.
