Basic Strategies for Interrogating a Witness

询问证人是刑侦人员普遍采用的一种侦查方法。为有效地从证人陈述中获取有价值的案件信息,既要遵守法定程序,更要讲究询问策略。询问人员应当预先弄清目击证人的作证资格,理性地分析其作证的心理特点,询问交流时应从方便证人的角度去选择询问的时间和环境,科学安排询问的步骤,讲究听取陈述的艺术。必要时还可利用认知询问技巧,引导证人更加全面地提取业已存储的记忆内容,使其陈述更接近于事实。

Interrogating a witness is a common strategy used the investigation of a crime. In order to get valuable information from the statement of the witness, the interrogator should not only follow legal procedures but also employ some strategies of interrogation. First, the interrogator should certify the qualification of a witness and analyze his psychology of bearing testimony. Then he should choose appropriate time and place of interrogation for the benefit of the witness, scientifically plan each step of interrogation and pay attention to the methods of taking the witness＇ s statements. If necessary, the interrogator may, by resorting to interrogating strategies, guide the witness to bring back his memory more thoroughly and get his statements closer to the facts.
