和谐社会是法治社会。和谐社会中的法治建设需要用最适合的成本获得最大、最满意、最长远的效果,才符合和谐的真正内涵。经济分析法学坚持把效益价值看作法律的基本价值,经济分析法学在中国发展的合理性和实践根据在于它和谐社会内在本质的要求,我们应对效益价值做出新的解读,从而使其对我国构建和谐社会下的法治建设——立法、司法、执法具有参考价值和借鉴意义。

The harmonious society is a society governed by law, in which the law construction needs to use the most suitable cost to obtain the biggest, the most satisfied, and the longest term effect. And only then it conforms to the true connotation of harmonist. The economic analysis legal science persisted in taking benefit value as the basis. The rationality and the practice of the economic analysis legal science lie in its basis of harmonious society intrinsic essence. Thus we should illustrate it from a new aspect to take reference from it in constructing our harmonious country in legislation, judicature, and the law enforcement.
