小浪底工程二标项目建设争议原因探析

Construction Dispute of the Lot 2 Division of Xiaolangdi Multipurpose Dam Project and Its Causes

通过研究小浪底工程二标项目建设产生争议的四个方面问题,根据当时的历史条件和工程环境对产生的争议进行比对分析,阐明FIDIC合同条件下管理逻辑的差异是造成二标项目建设产生争议的最主要的原因所在。

The four aspects of project disputes were approached in this paper, through a comprehensive analysis, during the construction of the Lot 2 division implemented by Chinese-German-Italian Contractors Joint Venture （CGIC JV）. The reasons and their impacts were analyzed on a comparative study under the conditions of FIDIC contract, and the conclusion was that the main difference, in terms of management logic for two parties involved in the construction of the Lot 2 division, caused those disputes.
