提倡设立城市规划的刑事责任制——一些国家和地区城市规划实践的启示

ON ADVOCATING CRIMINAL RESPONSIBILITY OF URBAN PLANNING

英国、新加坡、爱尔兰等国家以及香港地区都规定了有关城市规划领域违法开发行为的刑事责任追究制度。我国在城市建设领域方面也规定了有关的刑事责任,并且也有了相关的司法实践,但并没有设立直接对城市规划违法开发行为追究刑事责任的制度。依据以上情况并结合立法比较、观念发展、土地用途管制以及土地和房屋属性的分析认为,在我国,提倡设立城市规划的刑事责任是必要的,也是可行的。

Britain, Singapore, Ireland and Hong Kong have established criminal responsibility system of illegal conduct in urban planning. China also has related specifications in urban construction and judicial practice, but has no criminal sanction system in urban planning. Comparing the legislation, ideology, administration over land use, and attributes of land and property of those countries and areas with that of China, this paper argues that it is necessary and feasible to set up criminal liability in urban planning.
