失地农民权益保护问题的制度原因及法律对策

System Reason and Legal Countermeasures of Protecting the Rights and Interests of Landless Farmers

失地农民权益保护问题是当前的社会问题之一。制度供给的滞后或超前、制度消费的情况等都直接或间接地影响着失地农民现象在目前的"问题化"。失地农民权益保护应从源头做起,在宪法中明确农村土地征收补偿的原则,同时提高、拓宽征收补偿的标准及范围,探索以保障换土地的新型失地农民补偿方式,并完善法律援助机制,实现农民自我保护。

The problem of protecting the rights and interests of landless farmers is one of the most serious social problems. The lag or surpassing of system supplies and system consumption and so on all directly or indirectly affect ＂the questionization＂ of the phenomenon of landless farmers at present. To protect the rights and interests of landless farmers, we should take measures from the beginning, that is, making clear the principles of levying compen- sation for farming land in the constitution. Meanwhile we should enhance and broaden the standard and scope of levying compensation,explore the compensation methods for new landless farmers and perfect legal aid mechanism to realize farmers＂ self-protection.
