Discussion on the Logical Precondition of the Protection of Right

权利,既是一个法学概念,又是一个哲学、一个政治学、一个社会学概念,甚至还是一个伦理学概念。它是一个人作为人无法回避的问题,它直接关系到在一定社会样态下人们以何种状态活着,决定着人们行为的边界,确定着人们自由的空间。而平等却是这些自由空间的逻辑前提,是权利得以正确行使的保障。没有平等,就没有真正意义上的自由,也就没有真正现代意义上的权利。

The right is not only a concept of law, but also a concept of philosophy, politics and sociology, even a concept of ethics. As an unavoidable problem, it influences people＇ s living style under certain social conditions. The right determines the boundary of people＇ s action and the scope of people＇ s liberty. The equality as a logical precondition for the scope of liberty assures the implementation of the right. If there were no equality, there would be no true liberty and right in modern sense.
