摘要
研究目的:明确土地征收侵权原因,寻求解决土地征收侵权问题的对策。研究方法:比较分析法和实证分析法。研究结果:(1)土地征收侵权表现为超出"公共利益"范畴、未遵循"法定程序"、未给予"合理补偿"和"复合型"侵权4种类型;(2)立法缺失、政府职能错位、司法保障缺位是导致土地征收侵权发生的最主要原因。研究结论:解决土地征收侵权问题的对策是:完善立法、转变政府职能、健全司法保障。
The purpose of this paper is to make clear the causes that lead to the tort in land expropriation and to explore countermeasures. Methods of comparative analysis and investigation were applied. The results indicate that： （1） the four types of tort in land expropriation include the tort generated by surpassing ＂public interest＂ in practice, not complying with legal procedure, not giving just compensation, and the combined action of the former three ones; （2） the main reasons that lead to the tort in land expropriation are the imperfection of legislation, the inappropriate performance of governmental functions and the inefficiency of legal enforcement. The countermeasures include the perfection of legislation, the transformition of government functions, and the strengthening of the legal enforcement.
