Semantics Analysis of the Principle of Proportionality in Administrative Law

比例原则作为行政法中的"帝王条款",已在国外的理论研究和司法实践中获得普遍重视和不同程度的运用,因而成为其行政法学研究的热点之一。从行政法上的比例原则的内涵、比例原则与合理性原则的辨析,以及比例原则的划分方面着手,试图对行政法上的比例原则的内涵与外延进行法理学分析。

Having becoming ＂Emperor Provision＂ in the administrative law, the principle of proportionality is now obtaining popular attention and applications in theoretical study and judicial practice at abroad, becoming one of hot point in study of administrative law. This paper describes by means of connotation of the principle of proportionality, discriminate of the principle of rationality and division of the principle of proportionality, the analysis of connotation and extension of the principle of proportionality in ease of administrative law.
