摘要
为进一步保障人权应把"法律面前人人平等"的约束范围扩大到立法领域,抛弃以往该原则仅指法律适用上的平等的狭隘理解。同时,以往"法的阶级性"对立法平等的批判采用的是本质主义的方法论,违背了法的阶级性和超级性之间的辩证关系,忽略了矛盾发展的不平衡性。
In order to guarantee human rights, equality before law should be extended not only to the area of legal protection but also to the field of legislation. Simultaneously, the criticism of the ideology of class on equality is the essentialism, which is against the nature of the law, neglecting the imbalance of contradiction.
