我国无效婚姻制度的构建

On the Construction of the System for Invalid Marriage in China

无效婚姻制度是婚姻关系在法律意义上的一种体现。这个制度的构建,对于完善我国婚姻制度,建立和谐社会、法治社会有着极为重要的意义。本文在论述无效婚姻制度的法理基础、价值取向的前提下,指出了现行婚姻法中无效婚姻制度构建中存在的缺陷并加以完善的思路和办法。

The system of invalid marriage is an embodiment of marriage relationship in legal sense. The construction of this system has very important sense to the perfection of our country＇ s marriage system, and the construction of harmonious society and legal society. This paper, after discussing over the theoretical bases and value orientation of the invalid marriage system, points out the flaws existed in the construction of the present law of marriage about invalid marriage system and the measures taken to perfect it.
