Construction of Socialist New Countryside in the Sight of Lawful Rule

建设社会主义的新农村不仅有助于加强我国法治建设的社会基础,而且农村法治建设本身就是新农村建设的重要内容。因此,研究和解决这些问题对形成和建立我国的法的理论和法治模式具有重要意义。就内涵而言,“新农村”是以现行宪法制度为前提,以宪法所致力于构建的宪法秩序为基础的社会状态,并且这种社会状态应该是以法律为主要治理模式所形成的政治、经济、文化的和谐发展。建设社会主义新农村主要涉及农民主体地位、农村经济、农村治理、农村文化建设、农村社会保障、政府职能转变等六个方面的法律问题。

To construction socialist new countryside is helpful in the strengthening social basis in constructing ruling by law in our country, and the construction of ruling by law in the countryside itself is the important content in constructing new countryside. Thus, to study and solve all these problems is significant in formation and construction of the theory of law of our country and the pattern of ruling by law. As far as its connotation is concerned, ＂ new countryside＂ is the social condition taking the constitutional system prevailing now as the presupposition and constitutional discipline that the constitution aims at as the basis. And the social consition should be harmoniously developed in the politics, economy and culture, which is formed by taking law as its main managing pattern. To construct socialist new countryside is principally concerned with six law problems as the statue of the peasants as the main body, the economy of the countryside, the management of the countryside, the cultural construction of the countryside, the social guarantee of the countryside and the change of the government functions.
