论动产善意取得制度的适用范围

Acquisition in Good Faith System's Applicable Range of Movable Property

本文着重研究了善意取得制度的适用范围,传统的善意取得虽是动产所有权的善意取得,但并非所有的动产都适用,同时,在动产之外,并非没有扩大适用的空间。为此,文章分析了他物权等是否亦得适用善意取得,并提出了自己的理由。善意取得制度的存在是必要的,而且它的研究还在不断发展中,不再局限于动产所有权的善意取得的适用,逐步扩大善意取得制度适用是一个值得研究的课题。

overwhelmingly Acquisition in accepted and good faith system specified in the property part of the civil law is regulated in modem legislation. The thesis focuses on the system＇s applicable range of movable property. Although it is traditionally movable property＇ s acquisition in good faith, it is not actually applicable to all movable properties and there is potential enlarged space though it. In addition the thesis analyzes whether or not the Jura in Aliana is applicable to the system. Its existence is quite necessary. To gradually extend the system still deserves deeper research.
