在近现代四川盐业契约珍贵的诉讼档案中,反映出以盐业生产经营过程中各方约定俗成的厂规习惯来解决股权纠纷的特点。在诉讼程序的各个阶段,诉讼参加人自觉依据习惯法来谋求达成解决纠纷的合意,从而达到最大限度节约司法资源,降低诉讼成本的目的。分析盐业诉讼中的股权纠纷特点,借鉴我国传统纠纷解决方式中的有益成分,对于推动我国民事诉讼制度的转型和发展有着积极的意义。

In the rare lawsuit files of modem salt contracts from Sichuan, the characteristic, that the share dispute is resolved by the conventional factories＇ rules and customs in the process of the salt production and operation, is reflected.In the various phase of lawsuit, litigant participants consciously reach an agreement to resolve the dispute based on customary law so as to save maximum judicial resources and reduce litigation costs. We analyze the characteristics of the share dispute of lawsuit in the salt industry and emulate useful elements of China＇ s traditional dispute-resolved methods, which is of positive significance to promote the restructuring and developing ofChina＇s civil litigation system.
