On Crime of Illegal Harvesting Body Organs

随着医学技术的发展,人体器官移植变成了现实,但是这样的医疗方法所带来的并不全是救死扶伤的有利的方面。随着器官移植技术的发展,社会上渐渐出现了很多与器官移植相关的新型犯罪,这些犯罪有其特殊的犯罪构成和特点,但是我国刑法还没有相应的加以规制。本文在对人体器官移植所引发的新型犯罪进行分析的基本上提出了相关立法对策。

Organ transplantation comes true with the development of medical technology, but what it brings us are not all benefits. With the improvement of the organ transplantation, there gradually appear many new crimes related to organ transplantation. Those new crimes have its own characteristics, and we didn＇t regulate it in our criminal law. This paper analyzes countermeasures for the new crimes caused by the organ transplantation.
