企业合同约束机制的中国经验研究

Evidence of Contract Constraint Mechanism from Some Chinese Cities

本文通过问卷和访谈调查发现,中国企业努力营建的关系网确实起到了信誉保证机制和对合同的约束作用。尤其是拥有政府背景关系的企业比缺乏政府背景关系的企业在获取银行贷款上更有优势,但是这种优势对企业和地区的发展没有表现出积极意义。同时由于关系网的非强制性和地域性,关系对合同的约束作用受到限制,法律依然是约束合同关系的最后保障。

Based on a survey on the financial structure of Chinese firms in a few cities,relationship net, which Chinese firms make great efforts to construct, is found to act as contract enforcement mechanism. And relationship network with official background offers much more advantage than those without official background. Nevertheless, law system is still an ultimate contract constraint mechanism in China.
