人性论是中国古代法制建设中情法交融的思想基础,清代存留养亲制度中的情法兼顾具有惩治犯罪、安抚民心的功能。中国古代的情法兼顾与现代社会的"司法一元化"没有可比性。

The theory of human nature is the idea basis of the blending of kindred and law in the construction of ancient legal system. Proper attention to both kindred and law in the system of permitting culprit to support lineal elders in Qing dynasty has the funtions both punishing criminals and pacifying morale. Proper attention to both kindred and law in traditional society has no comparability with ＂judicial unification＂ in morden society.
