外资并购国有产权的政府规制分析

外资并购国有产权对于优化我国产业组织结构、增强我国企业国际竞争力等具有重大意义,但是,交易过程中的"寻租"和"合谋"行为导致国有资产流失,局部利益和整体利益、短期利益和长远利益关系的失衡等问题也不容忽视。我国既要鼓励引进外资,又要加强对在华跨国公司的规制;应尽快出台反垄断法,完善竞争法律体系,完善产业政策法规。我国政府对外资并购国有产权规制的取向应该是健全产业安全和反垄断预警机制,加强国有资产评估规范,针对不同类型的国有产权采取不同政策,促进公平竞争,营造有利于外资并购发展的制度环境。
