论我国资格刑的立法缺失、补足和完善

Legislation flaws,supplement and perfection of our country qualification punishments

资格刑并不是一个法定的附加刑,而是刑法理论上对剥夺犯罪人一定资格刑罚的统称和概括。随着社会的发展,资格刑在刑法体系中将发挥越来越重要的作用。但目前,我国刑法关于资格刑的规定还有许多不合理之处,也存在着一定的立法缺失。因此,需要立法完善和补足。

qualifications punishments are not the legal accessory penalties,but is the general designation and summary to the crime person deprived their certain qualifications theoretically.As the societal development,the qualification punishments will play more and more vital role in the criminal law system.But at present,our country criminal law about the qualification punishments has a lot of unreasonable stipulations and legislation flaws.Therefore,we needs to legislation consummation and supplement.
