论小区停车位及车库的归属——兼议对《物权法》第74条规定的理解 被引量:38

On Ownership of Parking Space and Parking Garage of Residential Communities——Understanding of Article 74 of Property Law

摘要 《物权法》第74条首次从法律层面,对停车位及车库的归属作出了规定。但是《物权法》没有区分停车位及车库的不同形式,进行类型化的规定。文章针对停车位及车库的权属争议,结合土地使用权分摊规则以及容积率标准,对不同形式的停车位及车库所有权的归属进行了分析,在此基础之上探讨了对《物权法》第74条中"其他场地"和"约定归属"含义的理解。 Article 74 of the property law has, for the first time at the level of national law, prescribed the ownership of parking space and parking garage. However, this law does not distinguish different forms of parking space and parking garage to provide category -specific prescriptions. In response to the disputes on the ownership of parking space and garage, on the basis of the allocation rule of land use right and the floor area ratio standard, this article will analyze ownership of different forms of parking space and parking garage and further discuss the author' s understanding of "other space" and "stipulated ownership" in article 74 of the property Law.
