摘要
行政执法是一种组织行为。只有以行政组织为起点,才能使得相对集中行政处罚权研究能够超越一般性的论述。行政边界的拓展意味着政府的活动在规模、范围和形式上的扩张,但行政边界与组织边界的关系并不是一一对应的关系。在我国行政管理的实践中,行政管理活动的过程一般可以分解为决策、执行、信息、咨询、监督等几个环节,如果把某些行政管理部门中的行政检查权和行政处罚权单独剥离出来,把性质上相近,技术上可行的合并,并由一个独立的相对集中行政处罚权机构来行使,这是符合整分合原理的,也和行政学上行政边界与行政组织边界的重构相一致。
The administrative law enforcement is one kind of organization behavior. Taking the administrative organization as the beginning, the research of the relative centralized administration punishment power can be able to surmount the general elaboration, in our country administration practice, the administration activity process generally may decompose into the decision-making, the execution, the information, the consultation, the surveillance and so on .several links, if we strips certain administration department's inspection power and punishment power, the whole administrative organization will run more effectively. Tt also consists with re construction of administrative boundary and administrative organization boundary.
