和谐社会环境下恢复性刑事政策的思考

Thoughts on Recoverable Criminal Policy under Circumstances of Harmonious Society

恢复性刑事政策旨在建立一个使犯罪人和受害人进入对话状态的"模式"。这一"模式"把犯罪人和受害人组织到一起,承认错误,分担并理解有害的影响,在补偿方面达成一致,就将来的行为构筑理解。现行的刑事政策应回应和谐社会的要求,将恢复性刑事政策作为建设社会主义和谐社会的概括性刑事政策,充分体现恢复性正义。

The recoverable criminal policy is due to establish a ＂model＂ in which the criminal and the victim are in the state of having a conversation. This ＂model＂ connects the criminal with the victim, and they acknowledge the mistake, share and recognize the negative influence. In addition, it achieves consistent understanding in compensation and the construction of future behavior. The present criminal policy should respond to the needs of harmonious society, regarding the recoverable criminal policy as the general criml 1 policy of building the harmonious socialist society and fully presenting the spirit of justice in restitution.
