In criminal action, there exists the conflicts between state power and the rights of the citizens. Such conflicts in the criminal compulsory measures performance was particularly conspicuous. Civil rights not only needs the protection of state power, but inevitably suffers undue power abuse. Hence the need to achieve state power and the rights of the citizens balances. In criminal compulsory measures, conflicts between state power and the rights of the citizens reflected in the criminal law applicable mandatory measures. From criminal compulsory measures＇ manifestations of conflicts between state power and the rights of the citizens, we try to find ways to resolve the conflicts, so as to safeguard the legitimate rights of the citizens.
