价值范式下的宪政

On constitutionalism under a value outlook

不管"宪政是民主政治"的观点,还是"宪政是宪法的具体实施状态"的观点,或"宪政是对权力的制约、监督、制衡及对人权保护"的观点,都无法得出"宪政是什么"的满意答案;而传统的三种综合回答"宪政是什么"的范式,也陷入了"宪政客观属性回答法"。鉴于此,以马克思、迪尔凯姆和韦伯的理论为依据,通过价值的范式,对"宪政是什么"进行了分析和回答。

Constitutionalism can not obtain a satisfied answer whether it is democratic politics or a real state of constitution or restriction, supervision, control and human right protection of rights. However, three traditional comprehensive answers to what constitutionalism is are restricted to objective answers to constitutionalism. As a result, according to the theories of Marx, Emile Durkheim and Max Weber, under a value outlook, this paper analyzes and answers what constitutionalism is.
