RMB Dispute:What WTO Rules Say?

在人民币汇率问题成为中美经贸关系中的一个争议点之后,美国国内部分人士提出要利用世界贸易组织的争端解决机制来迫使人民币升值,而一旦这样的提议成为现实,在WTO框架内解决人民币汇率争议将面临各种复杂的法律问题。针对美国国内利益集团对中国"操纵汇率"以及通过低估人民币的币值来补贴出口企业的指责,本文具体阐述了有关的国际贸易以及货币金融法律规则。此外,本文还对美国有可能提起的"非违法之诉"进行了法律可行性分析。

After RMB became a controversial issue of economic and trade relationship between China and the United States, some American suggested that the dispute settlement mechanism of WTO be used to force China to appreciate RMB. Once this proposal come into effect, many complex legal problems will occur within the WTO framework. This thesis elaborates the related legal rules of international trade and monetary finance in the light of the reasons by which U.S. interest groups blamed China for “exchange rate manipulation” and subsidy to export enterprises through underestimating RMB exchange rate. Besides, it analyzes the legal practicability of “non-violation complaints”, which may be put to use by the United States.
