论死刑执行中的“临终关怀”

本文通过阐述刑罚目的与临终关怀价值之间的关系,指出死刑执行中临终关怀这个命题存在的现实基础和当代意义。其次关注这个命题在实践中是如何展开的,从历史和当代、国内和国外、理论和现实多个角度描绘出死刑执行实践中的临终关怀现象,并尝试梳理归纳出临终关怀的方式种类;最后针对当前死刑执行中存在的临终关怀现象指出其存在的问题。

This article points out the current foundation and significance of Hospice Care in Execution through explanation of the relationship between the purpose of penalty and the merit of Hospice Care.and it also focuses on the implementation of this proposition,tracing out all the aspects in execution,in history and at present,in China and abroad,in theory and in practice.at last,this article points out the problems of Hospice Care in Execution in current days.
