论和谐社会视角下行政救济模式的完善——兼论当代公共行政发展对行政救济模式的影响

On Administrative Relief Pattern under the View of Harmonious Society——Concurrently discuss the public administrative development influencing to the administrative relief pattern

随着公共行政的发展,行政法与行政救济模式受到了冲击。为实现公民权利的有效和无漏洞的救济,势必要对行政救济模式做适应的调整:一方面适当扩大行政救济的范围,将社会公权力及非强制性的行为纳入到行政救济范畴中来;另一方面扩充行政救济的种类,尤其是非诉的救济措施,才能"最大限度地增加和谐因素","最大限度地减少不和谐因素","不断促进社会和谐",构建社会主义和谐社会。

The public administration development has an impact on administrative relief pattern. In order to realize citizens＇ fights effectively and the non- loophole relied,it is essential to adjust the administrative relief pattern in two aspects. On one h_and,to expand the administrative relief scope and take the non- compulsory behaviors and social male authority into it; On the other hand, to expand administrative resouea types,especially in non- litigation measures so harmonious society can be constructed in respect of“maximunl increase the harmonious factor”, “maximum reduce unharmonious factor”, “unceasingly promote the society to be harmonious”.
