城乡分割、程序失范与农民利益——城市化进程中失地农民利益的经济学分析

An Economic Analysis of the Interests of the Farmers Who Lose Their Lands in the Disorderly Process of Urbanization

在我国城市化进程中,城乡土地制度分割和政府征地行为失去约束是造成失地农民利益受损的制度性根源。制度分割导致征地的法定补偿标准失去合理性,而政府滥用征地权又进一步使实际补偿低于法定补偿标准。因此,开启城乡土地直接交易的市场通道和构建有效的征地程序是保障失地农民利益的两项关键性举措。

This paper attempts to analyze the farmers＇ interests in rural land requisition from an economic perspective. The author holds that the segmented administration in land requisition has done serious harms to the farmers＇ interests mainly by setting up arbitrary and unjust criteria of compensation. Government compensation for land loss is also practically lower than the legal criteria. The author proposes two institutional reforms, namely, the introduction of procedural restraints and the establishment of a direct land market between urban and rural areas.
