论无效婚姻制度及其完善

On Void Marriage System and its Improvement

2001年修改后的婚姻法增加了无效婚姻制度,填补了以往婚姻法律规范中关于无效婚姻制度的空白。与无效婚姻有关的各种法律制度,是保证结婚的各种条件和程序付诸实施的必要手段,是结婚制度的重要组成部分。世界各国大多将无效婚姻制度作为婚姻成立制度的一部分加以明确规定。我国现存无效婚姻制度虽然对我国的婚姻法律制度起到很重要的补充作用,但仍然有不足之处需要完善。该文就无效婚姻制度的现行规定以及其存在的不足之处进行探讨。

Void marriage system is added into the marriage law amended in 2001, which fills in gap that void marriage system is not treated in the marriage laws before. Laws concerning void marriage system constitute an integral part of the marriage system and are the means as well needed for the marriage conditions and all the formalities to go through. In most countries of the world void marriage system is expressively prescribed as a part of the of the marriage establishment system. Though the prevailing void marriage system plays an important role in the marriage law system, there is deficiency to be improved. This paper deals with the prevailing regulation of void marriage and its deficiency.
