在专利申请中披露遗传资源的来源是促进《生物多样性公约》目标的实现与遗传资源的获取和惠益分享法律规范实施的重要措施。就披露要求的法律基础而言,目前尚不存在一项统一的法律基础,既有的专利法和其他法律制度中的法律原则为披露要求提供了法律基础。关于披露要求的性质,应当同时具有形式和实质两个方面。未遵守披露要求的后果与披露要求的性质紧密相连,包括专利法上的和专利法之外的多种后果。

Disclosure of origin of genetic resources in the patent application is an important measure to promote the realization of the aims of Convention on Biological Diversity and the implementation of legal rules of access to genetic resources and benefit sharing. As far as the Legal basis of disclosure requirement is concerned, there is no one uniform legal basis and existing patent law and other legal system are providing legal basis for disclosure requirement. As for the nature of disclosure requirement, the nature of disclosure requirement has formal and substantive aspects. The consequences of failure to comply with disclosure requirement are closely associated with the nature of disclosure requirement and they include many consequences in the patent law and outside the patent law.
