北京市社区矫正调查

A Survey of Community Correctional System in Beijing

社区矫正是一种不使罪犯与社会隔离并利用社区资源教育改造罪犯的非监禁刑模式,是所有在社区环境中管理、教育罪犯方式的总称。笔者在北京社区矫正调查中发现,以下几个问题是建立社区矫正制度面临的困惑,也是社区矫正制度建立必须解决的几个问题:社区矫正是刑罚还是行刑方式;社区矫正法律依据与现行法律之间的矛盾;社区矫正工作者角色定位和社区矫正的执行问题等。因此,制定社区矫正法;对罪行较轻的、被判缓刑的青少年犯罪者进行"洗牌";将矫正对象的劳动技能培训与心理矫治作为一项制度和加强社会志愿者队伍的储备、调动社会志愿者的积极性等措施应当成为进一步完善社区矫正制度的当然选择。

As a model of punishment differentiating from a punishment against liberty, community correction is one kind of community - based treatment ways. It carries out administration and education for criminals in the com- munity environment. It helps to combine criminals with society, and to promote the function of educational reforma- tive punishment for criminals by using social resources fully. There have been some perplexities faced below in reconstruct community correctional institution through a finding of investigation in Beijing. They are as followings： community correction is a penal or one way of punishments ; legal basis of community correction and its present reg- ulation are in conflict; both subject of community correction and its implement problem; and so on.
