关于公安机关内设机构及派出所独立行政执法的法律思考

Think about Independent Enforcement of Departments inside Public Security Organs and Police Substations

公安机关内设的交通管理、消防管理、边防管理机构和派出所依法取得独立行政执法主体资格,以自己的名义独立行使部分行政管理职权,并独立承担相应的法律责任。但是,这些机构依法取得的行政主体资格是有限的,因而他们独立行政执法的范围、权限,以及所承担的责任也是有限度的。这些内设机构和派出所以自己的名义独立行使部分行政管理职权,应当做到合法、及时、适度。应当进一步完善行政法制,规范有关授权立法和行为,明确执法责任和完善执法监督机制,提高执法民警的能力和水平,不断规范公安机关内设机构和派出所的独立行政执法活动。

Independent enforcement of The departments inside public security organs and police substations such as traffic administration, administration of fire prevention and control, frontier station and police substation have the authority of independent enforcement law in according to legal regulations. But in fact, these departments ＇authority of independent enforcement law has been limited. Administrative legal system should be perfected greatly, authorized legislative action concerned should be regulated, supervisory machinist of enforcement law should be enhanced and police＇s level of enforcement law should be promoted.
