摘要
教育民营化的实质是在公共教育领域引入市场竞争机制,从整体上减少政府的介入程度,改变政府的介入方式,打破政府部门对公共教育的垄断,形成一种由政府部门和非政府部门共同提供的,多样化、高效率的公共教育供给机制。它与教育的公共性是途径与目标的关系。为保证教育公共性的实现,必须从立法、执法、司法各个层面规范教育民营化过程中不同主体的行为,明确政府在民营化中的义务与责任,以使教育民营化过程有利于教育公共性的实现,从而为教育民营化创造公平竞争的法律环境。
By introducing the mechanism of market competition to public education, private education has broken the traditional way of government's monopoly of public education. Government intervenes less, as it provides an efficient mechanism for public education together with non-governmental organizations. The privatization of education brings about education commonality. It is necessary to regulate the behavior of different subjects during the process of education prlvatizatlon, and make clear government's obligation and responsibility in the privatization, so that the process will distributes to realize education commonality, which would creates a legal environment of fair competition for the privatization of education in return.
