遗弃罪中扶养义务的诠释——由一则案例引发的思考

On the Nurture Duty of Abandonment Crime

近年来出现的新型遗弃行为,使我国刑法中的遗弃罪立法面临新的挑战,是遵从立法原意,还是做出客观解释,使之适应社会发展,存在争议。拟以客观解释方法为路径来阐述扶养义务的范围,以及遗弃罪主体的界定。

The new abandonment behavior appeared in recent years caused the abandonment crime in our criminal law faced with the new challenge. There is a dispute of complying with the original intention of legislation, or making the objective interpretation. This article argue the scope of nurture duty with the way of objective interpretation, as well as the subject of abandonment crime.
